1. Agreement Between User and Johnson County Pools

These Terms and Conditions govern your use of the Johnson County Pools website (johnsoncountypools.com) and the services provided by Johnson County Pools. By using our website or engaging our services, you accept these terms in full. If you disagree with any part of these terms, please do not use our website or services.

 

2. Services

Johnson County Pools provides pool maintenance, repair, replastering, and educational services to residential customers in Johnson County, Texas and surrounding areas. Our services are subject to a separate service agreement that will be provided upon scheduling.

 

2.1 Service Scheduling

Pool services are scheduled based on availability and are subject to weather conditions and other factors outside our control. While we strive to maintain scheduled appointments, we reserve the right to reschedule when necessary. We will make reasonable efforts to notify you of any changes.

 

2.2 Service Standards

Johnson County Pools commits to providing professional pool services performed by trained technicians. We aim to meet or exceed industry standards and comply with all applicable regulations.

 

3. Property Access and Customer Responsibilities

 

3.1 Access to Property

By scheduling our services, you agree to provide reasonable access to your pool and related equipment during scheduled service times. This includes ensuring gates are unlocked, pets are secured, and access paths are clear and safe.

 

3.2 Customer Responsibilities

You are responsible for:

• Maintaining water level between service visits

• Notifying us of any issues between service visits

• Providing accurate information about your pool and equipment

• Ensuring electricity is available for pool equipment operation

• Following any recommendations for safe pool usage

 

4. Payment Terms

 

4.1 Pricing

Service prices are subject to change. Current pricing will be provided upon request or quote. Prices may vary based on pool size, condition, equipment, and specific requirements.

 

4.2 Payment Methods

We accept payment via credit card, cash, and electronic payment methods. Different payment options may be available for regular maintenance versus repair or renovation services.

 

4.3 Billing Cycle

For regular maintenance customers, billing occurs on a monthly basis. One-time services and repairs are typically billed upon completion of the service.

 

4.4 Late Payments

Payments not received within 15 days of the invoice date may be subject to a late fee of 10% per month or the maximum allowed by law. Continued non-payment may result in suspension of services.

 

5. Cancellation Policy

 

5.1 Regular Maintenance Cancellation

Regular maintenance customers may cancel service by providing 180 days' written notice. Any prepaid amounts for services not yet rendered will be refunded.

 

5.2 Specific Appointment Cancellation

For scheduled one-time services or repairs, cancellation must be made at least 48 hours in advance to avoid a cancellation fee, which may be up to 25% of the scheduled service cost.

 

5.3 Company-Initiated Cancellation

Johnson County Pools reserves the right to refuse or cancel service at our discretion. If we cancel a prepaid service, a full refund will be issued for the undelivered service.

 

6. Warranties and Limitations

 

6.1 Service Warranty

We guarantee our workmanship for 30 days following service. If you experience issues related to our work within this period, we will address them at no additional cost.

 

6.2 Parts and Materials Warranty

Parts and materials are covered by manufacturer warranties. We will assist with warranty claims for parts installed by Johnson County Pools.

 

6.3 Limitation of Liability

Johnson County Pools is not liable for:

• Damage resulting from normal wear and tear

• Issues caused by customer negligence or misuse

• Problems arising from undisclosed or unknown conditions

• Damage from acts of nature or circumstances beyond our control

• Consequential or incidental damages

Our total liability is limited to the amount paid for the specific service in question.

 

7. Property Damage and Insurance

 

7.1 Property Protection

Our technicians take reasonable care to protect your property. However, maintaining pool areas free of fragile or valuable items remains the customer's responsibility.

 

7.2 Insurance

Johnson County Pools maintains comprehensive liability insurance. Proof of insurance is available upon request.

 

7.3 Claims Process

Any claims for property damage must be reported within 48 hours of service. Claims will be investigated promptly and resolved according to our insurance policies.

 

8. Privacy Policy

 

8.1 Personal Information

We collect and use your personal information according to our Privacy Policy, which is incorporated into these Terms and Conditions by reference.

 

8.2 Service Records

We maintain records of services performed, chemical readings, and pool conditions to provide better service. These records are considered confidential.

 

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Johnson County, Texas.
